You must be at least 13 years old to use the Service, and old enough to form a binding contract in your country. Money features — the wallet, payments, and fundraising — are available only to users who meet the minimum age and identity-verification requirements under the law of their country. By using the Service you confirm that the information you give us is accurate and that you are not barred from using it under any applicable law or sanctions list.
You are responsible for keeping your account credentials secure and for all activity under your account. Tell us promptly if you suspect unauthorized use. You must provide accurate registration information and keep it up to date. We may require additional verification (including identity verification) before enabling certain features, particularly those that move money.
You agree not to use the Service to:
We may investigate suspected violations and may remove content, or suspend or terminate accounts, as described below.
You keep ownership of the content you create and send. You grant us the limited licence needed to operate the Service — for example, to transmit, store, and back up your content and deliver it to the people you send it to. Because one-to-one and group chats are end-to-end encrypted, we cannot read their contents; our ability to moderate that content depends on user reports and on information that is not end-to-end encrypted. You are responsible for the content you share and for having the rights to share it.
The wallet lets you send and receive money through third-party mobile-money operators (such as M-Pesa, MTN MoMo, Airtel Money, Wave, Orange Money, and OPay). AxcessAfrica is a technology platform, not a bank, and does not hold deposits or pay interest. Actual movement of funds is carried out by the relevant operator and is also governed by that operator's own terms. You are responsible for the accuracy of payment details — transfers sent to the wrong recipient may be impossible to reverse. You must complete any required identity verification before transacting, and you may not use the wallet for any unlawful purpose. Any fees will be shown to you before you confirm a transaction.
Anyone who creates a fundraiser is solely responsible for its legitimacy, for using funds as described, and for meeting any legal or tax obligations. AxcessAfrica does not guarantee that any campaign is genuine or that funds will be used as stated, and is not a party to the relationship between organizers and donors. Donations may be final. We may hold, review, suspend, or refund campaigns that appear fraudulent or that violate these Terms or the law.
Where the Service lets users list products or services and transact with each other, those transactions are between the users involved. AxcessAfrica is not the buyer or seller and is not responsible for the quality, safety, legality, or delivery of items listed by users.
The Service works with third parties — including mobile-money operators, telecom providers for SMS and USSD, and cloud infrastructure. Your use of those services may be subject to their terms, and we are not responsible for their acts or omissions.
The AxcessAfrica name, logo, and the software and design of the Service are owned by us or our licensors and are protected by law. These Terms do not give you any right to use our brand except as needed to use the Service normally.
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Some obligations survive termination — including those relating to the money you owe, the financial and compliance records we are required to keep, and the disclaimers and limitations below.
The Service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that messages and payments will always be delivered without delay. Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded.
To the fullest extent permitted by law, AxcessAfrica will not be liable for indirect, incidental, special, or consequential losses, or for lost profits, data, or goodwill, arising from your use of the Service. Nothing here limits liability that cannot lawfully be limited (such as for fraud or for death or personal injury caused by negligence).
You agree to indemnify AxcessAfrica against claims and costs arising from your misuse of the Service, your content, or your breach of these Terms or of the law.
These Terms are governed by the laws of [GOVERNING JURISDICTION], and disputes will be handled by the courts of [GOVERNING JURISDICTION], unless the mandatory law of your country of residence provides otherwise.
